Navigating Telemarketing Laws: Information Regulator's Directives Under POPIA 

Regulators are taking steps to address telemarketing concerns under POPIA, with the Information Regulator finalizing a guidance note to clarify compliance with the Protection of Personal Information Act. 

The initiative responds to ongoing challenges faced by South Africans with telemarketers, aiming to provide clarity on how the direct marketing sector should operate within POPIA regulations. 

Advocate Pansy Tlakula, Chair of the Information Regulator, highlighted a potential loophole in POPIA regarding electronic communication interpretation. Tlakula emphasized the need for clarity, particularly in understanding what constitutes electronic communication under the Act.

Concerns extend to SMS and email marketing, where Tlakula noted a lack of recipient consent among many companies. She stressed the importance of obtaining consent before sending direct marketing messages and ensuring compliance with opt-out requests. 

 The forthcoming guidance note aims to address interpretation challenges and provide clear directives for the telemarketing sector to align with POPIA regulations, according to the Information Regulator.
